Temporary Debt Protection (TDP) is a legal provision that grants a 21-day protection period during which unsecured creditors cannot take court-ordered enforcement action to recover debts. This means they cannot garnish wages or have the sheriff seize goods. It is considered an act of bankruptcy, which a creditor could use as a basis to initiate bankruptcy proceedings against the debtor.

Upon acceptance of your TDP application, you receive 21 days of protection from certain enforcement actions by unsecured creditors, like wage garnishment or asset seizure by the sheriff. This period allows you to seek financial advice, negotiate payment plans, or consider formal insolvency options. However, secured creditors can still repossess assets over which they hold security, and the protection does not cover all types of debts, such as child support or court fines.

Anyone facing unsecured debts they cannot pay may apply for TDP, particularly if they are experiencing enforcement actions by creditors. However, individuals who have had TDP accepted within the last 12 months, are currently under a debt agreement or personal insolvency agreement, or have been served with a Creditor’s Petition filed in court, are ineligible.
